Personal Data Protection Policy

This policy explains what personal data we process, for what purpose, and how you can exercise your rights. It is governed by Colombian Law 1581 of 2012, Decree 1377 of 2013 and the remaining Colombian personal data protection rules.

1. Data controller

The controller of your personal data is AITSS (AI Technology Smart Solutions), domiciled at Carrera 59 # 66-86, Barranquilla, Colombia, tax identification number (NIT) 901.908.250.

2. What we collect, and when

We collect only the data you deliberately provide, together with the minimal technical data that accompanies it. We use no analytics or advertising tools, and this site loads no third-party resources.

When you write through the contact form: first name, last name, email address, subject and the content of your message.

When you book a conversation: name, email address, time zone and whatever you choose to add about the purpose of the meeting.

When you download a guide: name, email address and the professional details the form requests, together with your IP address and browser identification.

The IP address and browser identifier are recorded for two specific reasons: to prevent automated submissions, and to keep evidence of the time and origin of the authorisation you grant. They are not used to profile you or for advertising.

We do not collect sensitive data within the meaning of article 5 of Colombian Law 1581 of 2012 (racial or ethnic origin, beliefs, health, biometric data or sexual orientation), nor data concerning minors. Please do not include such data in your messages.

3. What we use it for

  • Answering your request and continuing the conversation you started.
  • Arranging and confirming the meetings you book.
  • Delivering the material you expressly requested.
  • Sending you analysis and publications, only if you gave separate authorisation and for as long as you do not withdraw it.
  • Meeting legal obligations and keeping evidence of the authorisation granted.

We do not sell, assign or exchange your data with third parties for commercial purposes, and we make no automated decisions affecting you.

4. Authorisation

Processing is based on the prior, express and informed authorisation you give by ticking the corresponding box before submitting any form. That authorisation is voluntary: without it we cannot handle your request, but you may browse the site freely.

You may withdraw your authorisation at any time through the channels set out in this policy, unless a legal or contractual duty requires us to retain the data.

5. Cookies

This site uses no analytics, advertising or cross-site tracking cookies, and embeds no third-party scripts.

Only technical cookies strictly necessary for operation are used: those remembering your light or dark theme preference, those handling secure form submission, and session cookies if you sign in to the administration panel. Being strictly necessary they require no prior consent, and you can delete them from your browser.

6. How long we keep it

We keep data for as long as the purpose that motivated its collection requires, and afterwards for the period in which legal liability could arise.

  • Contact messages and bookings: for the duration of the relationship and up to two years after the last contact.
  • Material download data: up to two years from the download.
  • Publication subscriptions: until you unsubscribe.
  • Authorisation records: while the data is being processed and for the subsequent statutory limitation period.

7. Who else is involved

Your data is hosted on our hosting provider’s infrastructure and processed by the form, booking and email tools installed on this same site. These providers act as processors, acting solely on our instructions.

Sending email may involve an outbound email service provider. In every case we require contractual confidentiality and security conditions equivalent to our own.

8. International transfers

The servers hosting this site may be located outside Colombia. Where that is the case, the transfer relies on the authorisation you grant and on the contractual safeguards agreed with the provider, in accordance with article 26 of Law 1581 of 2012.

9. Your rights and how to exercise them

As the data subject you have the right to know, update and rectify your data; to request evidence of the authorisation granted; to be informed of the use made of it; to withdraw your authorisation or request deletion where no legal duty requires retention; and to lodge a complaint with the Colombian Superintendence of Industry and Commerce.

To exercise them, write to contactanos@aitss.com.co stating your name, the right you wish to exercise and a channel for our reply. Enquiries are answered within ten business days and complaints within fifteen business days, in accordance with articles 14 and 15 of Law 1581 of 2012. If a deadline cannot be met we will tell you why and when it will be met.

10. Security

We apply reasonable technical and organisational measures to protect your data: encryption in transit, access control to the administration panel, and minimisation of the data requested. No system is infallible; should an incident affecting your data occur, we will inform you and report it to the competent authority as required by applicable law.

11. Term and changes

Processing of browsing data (IP address and geolocation)

In compliance with Law 1581 of 2012 (Colombia) and the GDPR (European Union), AI Technology Smart Solutions (AITSS) informs you that, when you register on our resource pages and make secure downloads, we automatically capture your IP address and approximate geolocation (country and city), for the following purposes:

  • Prevention of fraud and abuse in downloads.
  • Geographic segmentation of informational content.
  • Site security and incident auditing.

You have the right to access, update, rectify and delete your data, and to withdraw the authorisation granted, by writing to contactanos@aitss.com.co. By interacting with our forms and making downloads, you expressly consent to this processing.

This policy applies from its publication date and supersedes any earlier version. If we change it substantially, we will publish the new version at this same address with its update date.
